We may update this Privacy Policy from time to time. When we make changes, we will revise the “Last Updated” date at the bottom of this policy and post the updated version on the Service. If we make material changes, we will provide additional notice, such as by email or through a notice on the Service, where required by applicable law. Information We Collect

Information you provide to us. We collect personal information you provide directly, which may include:

  • Identity and contact data: your name, email address, telephone and mobile number, and mailing address.
  • Business data: information about your business or organization, including the number of trucks or assets you manage with the Service.
  • Account data: your username, password, and account preferences.
  • Payment data: billing address and payment method information, which is collected and processed by our third-party payment processors (we do not store full payment card numbers on our systems).
  • Communications and support data: information you provide when you contact us, request support, respond to surveys, or provide feedback or testimonials.

Information we collect automatically. When you use the Service, we may automatically collect certain technical and usage information, such as your IP address, device and browser type, operating system, app version, pages and features viewed, and the dates and times of your interactions. We collect this information through cookies and similar technologies as described in our Cookie Policy.

How We Use Your Information

SMS / Text Messaging

This section describes how we collect, use, and share information in connection with our text messaging (SMS) program.

Phone and consent data we collect. When you opt in to receive text messages from us, we collect and maintain:

  • the mobile phone number you provide;
  • a record of your consent, including the date, time, and method by which you opted in (for example, through a web form, account setting, written or verbal agreement, or by texting a keyword); and
  • message activity, such as the content, delivery status, and timestamps of messages we send to or receive from you, and your opt-out requests.

How we use this data. We use your mobile number and consent records solely to operate our messaging program, including to:

  • send transactional and service messages such as appointment, dispatch, scheduling, account, billing, and software-update notices;
  • send informational or promotional messages where you have consented to receive them; and
  • maintain proof of consent, honor opt-out requests, and otherwise comply with applicable law and carrier requirements.

By providing your mobile number and opting in, you consent to receive recurring automated text messages from Tank Track at that number. Message frequency varies. Message and data rates may apply. Consent to receive marketing text messages is not a condition of purchasing any product or service.

How we share this data. Mobile information will not be shared with third parties or affiliates for marketing or promotional purposes. All of the categories described in the “How We Share Your Information” section below exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties. We share your mobile number only with the service providers that help us deliver messages on our behalf — such as our messaging platform, communications service provider, SMS aggregators, and mobile carriers — and only to the extent necessary to transmit those messages. We do not sell your mobile information or text-messaging consent data.

Opting out and help. You can opt out of text messages at any time by replying STOP to any message you receive from us. After you opt out, we will send a single confirmation message and will not send further texts unless you opt in again. For help, reply HELP or contact us at [email protected] or (833) 826-5875. Opting out of text messages will not necessarily stop other communications, such as email, that you may receive from us.

How We Share Your Information

We do not sell your personal information, and we do not share it for cross-context behavioral advertising. We may share your information in the following limited circumstances:

With vendors and subcontractors that perform services on our behalf, such as payment processing, hosting and cloud infrastructure, analytics, advertising support, communications and messaging delivery, and customer support. We require these providers to use your information only to provide services to us and to protect it appropriately.
  • Payment processors. With our third-party payment processors as necessary to process transactions you authorize, as further described in our Terms of Use.
  • Legal and safety. To comply with applicable law, regulation, legal process, or governmental request; to enforce our agreements, including our Terms of Use; to protect the rights, property, or safety of Tank Track, our users, or others; and to detect, prevent, or address fraud or security issues.
  • Business transfers. In connection with, or during negotiations of, a merger, acquisition, financing, reorganization, or sale of all or a portion of our assets, in which case your information may be transferred as part of that transaction.
  • With your consent. In other circumstances with your consent or at your direction.

As noted in the SMS / Text Messaging section, text messaging originator opt-in data and consent are excluded from all of the sharing categories above and will not be shared with any third parties except the service providers that deliver messages on our behalf.

Retention of Your Information

We retain your personal information for as long as your account is active or as needed to provide the Service and fulfill the purposes described in this Privacy Policy. We may retain certain information for longer periods where necessary to comply with our legal obligations, resolve disputes, enforce our agreements, prevent fraud, and maintain appropriate business and financial records. When information is no longer needed, we will delete or de-identify it. Residual anonymous or aggregated information that does not identify you may be retained indefinitely.

Your Privacy Rights

Depending on where you live and the laws that apply to you, you may have rights to:

  • correct inaccurate or incomplete personal information;
  • delete your personal information;
  • restrict or object to certain processing of your information;

Tank Track does not sell your personal information and does not share it for cross-context behavioral advertising. We will not discriminate against you for exercising any of your privacy rights.

The Service is intended for businesses and is not directed to children under the age of 16. We do not knowingly collect personal information from children.
